becomes more complex when a graduate needs to restore student status because
their study permits expired before they applied. In these cases, IRCC assesses
both PGWP eligibility and whether the applicant qualifies for restoration.
Refusals most often occur for timing, status compliance, and missing evidence.
1. Missing the 90-day restoration
window
If the study permit expires and the
applicant did not change to visitor status before expiry, IRCC allows up to 90
days after the study permit expiry date to apply for a PGWP and restore status
as a student. If the application is submitted after the 90-day window, IRCC’s
instructions indicate the person must leave Canada, and a PGWP filed with late
restoration can be refused.
2. Missing the 180-day PGWP deadline
Even if restoration is possible, applicants
still must respect the PGWP filing deadline of up to 180 days after receiving
confirmation of program completion. If a person applies late because they
waited too long after graduation, refusal risk increases.
3. Not eligible for restoration due
to noncompliance
Restoration is not automatic. If IRCC
believes the applicant failed to comply with permit conditions before expiry,
such as unauthorized work or other violations, restoration can be refused and
the PGWP can be refused as a result.
4. Incorrect fees or missing
restoration fee receipt
When restoration is required for a PGWP,
IRCC requires the PGWP fee plus the restoration fee. IRCC also notes that, due
to system limitations, applicants must pay the restoration fee separately and
upload the receipt to the PGWP application. Missing fees or missing proof of
payment commonly leads to refusal or return.
5. Working while in restoration
If the study permit is expired and the
applicant is restoring status, IRCC states the person cannot work until the
PGWP is approved. Working during this period can create noncompliance concerns
that harm the application.
