routine “extension” option. It is a discretionary permit used in exceptional
situations when a person is inadmissible or otherwise does not meet the
requirements to remain in Canada, but there are compelling reasons to allow
them to stay temporarily.
In limited cases, a TRP combined with a
study permit extension or a new study permit application from inside Canada can
be a practical strategy.
1. The person is out of status and
restoration is not available
If a study permit expires and the person
did not apply in time, restoration may be possible only within the restoration
rules and deadlines. If the person is beyond restoration eligibility or has
complications that prevent restoration approval, a TRP may be considered in
truly exceptional circumstances, especially where there are strong humanitarian
factors or serious consequences if the person must leave Canada.
2. The person is inadmissible but
needs to continue studies for a compelling reason
A TRP may be appropriate where
inadmissibility exists (for example, certain compliance issues or other
inadmissibility grounds) and the person has a well-documented, time-sensitive
reason to remain in Canada. If IRCC issues a TRP valid for at least 6 months,
the person may be eligible to apply in Canada for a study permit.
3. The TRP validity supports
continued studies and stability
A practical threshold is the TRP validity
period. IRCC specifically notes that foreign nationals with a TRP valid for at
least 6 months can apply in Canada for a study permit, and regulations also
reference TRP holders (valid at least 6 months) in the context of potential
work permit issuance. This matters because a short TRP may not provide enough
stability for an academic plan.
4. The study plan remains credible
and compliance can be demonstrated
Even with a TRP, the person must still
satisfy study permit requirements and provide updated proof of enrollment,
academic progression, finances, and a clear study plan when applying to extend
or change conditions as a student.
In summary, TRP plus a study permit
extension is typically only a good idea when there is a genuine inadmissibility
or status barrier, strong humanitarian or compelling factors, and a credible
pathway to continue studies with clear documentation.
When study permit restoration is no longer
