MPNP Procedural Fairness Letter (PFL): Work Permit Expired After MPNP Application Submission and Before Nomination
If your work permit expires after
you have submitted your MPNP application but before a nomination is issued,
the expiry may affect your application where your MPNP pathway depends on ongoing Manitoba employment, valid work
authorization, or continued compliance with the requirements under which you
applied.
If your work permit has expired
or will expire within the next 45 days, you should notify the MPNP through
the Skilled Worker Webform. The MPNP
has advised that applications involving expired or soon-to-expire work permits
may be prioritized for assessment.
Depending on the assessment of your application, the MPNP may proceed
with the nomination or, where
applicable, issue the documentation necessary to support a work permit
application. In cases requiring an employer-specific LMIA-exempt work permit,
the employer may also be required to complete the Employer Portal process and pay the applicable employer compliance fee.
However, informing the MPNP about an expiring work permit does not automatically guarantee nomination or
the issuance of a work permit support letter. The application must still
meet the applicable MPNP requirements.
Frequently Asked Questions
1. Can my MPNP application be affected if
my work permit expires before nomination?
Yes. This can affect your application where your
MPNP pathway requires ongoing Manitoba employment, valid work authorization, or
continued compliance with pathway requirements.
2. Should I inform MPNP if my work permit
is going to expire soon?
Yes. If your work permit has expired or will expire
within the next 45 days, you should notify MPNP through the Skilled Worker
Webform.
3. Can MPNP prioritize my application if my
work permit is expiring?
Yes. MPNP may prioritize applications where the
applicant’s work permit has expired or is close to expiry. However, priority
processing is not guaranteed.
4. Can MPNP issue a work permit support
letter if my work permit is expiring?
In some cases, MPNP may issue documentation to
support a work permit application if the applicant meets the applicable
requirements. The employer may also be required to complete the Employer Portal
process and pay the employer compliance fee.
5. Does an expiring work permit
automatically mean MPNP will issue a nomination or support letter?
No. MPNP must still assess whether you meet all
applicable program requirements. An expiring work permit does not automatically
guarantee a nomination or work permit support letter.
