A Procedural Fairness Letter (PFL) is
issued when an IRCC officer has serious concerns that could lead to refusal or
inadmissibility and gives the applicant a chance to respond before a final
decision.
Common reasons include:
1. Misrepresentation concerns
This is one of the most serious triggers.
IRCC may suspect that information was withheld or that documents are
inaccurate, altered, or not genuine. Misrepresentation findings can lead to
refusal and a multi-year bar from applying again.
2. Work experience or NOC
credibility issues
In economic PR streams, officers may
question whether job duties match the claimed NOC, whether the hours are
eligible, or whether employer documentation is reliable. PFLs commonly follow
concerns about weak reference letters or unverifiable employment evidence.
3. Proof of funds credibility and
source of funds
When funds appear inconsistent, recently
deposited without explanation, or not clearly available to the applicant, IRCC
may issue a PFL instead of a routine ADR, especially where the officer suspects
the documents do not reflect the true financial picture.
4. Relationship genuineness in
family sponsorship
In spousal or partner sponsorship, IRCC may
issue a PFL if the relationship appears not genuine or entered primarily for
immigration purposes, or if timelines and evidence do not align.
5. Medical inadmissibility,
including excessive demand
If medical results suggest potential
excessive demand on Canada’s health or social services, IRCC may issue a PFL to
allow the applicant to respond with updated medical evidence and a mitigation
plan.
6. Criminality, security, or
background credibility issues
PFLs may also be issued when police
certificates, court outcomes, identity documents, or background history create
admissibility concerns or contradictions requiring an explanation.
