Inadmissibility for cessation is prescribed is Section 40(1) of
the IRPA (Immigration and Refugee Protection Act) and applies to foreign
nationals and permanent residents for whom refugee protection has ceased.
Cessation is usually triggered by the Minister making an application to the Refugee
Protection Division (RPD) of the Immigration and Refugee Board of Canada under
Section 108 of the Act. The RPD then determines whether refugee protection has
ceased. Cessation is final and can result in loss of status and removal from
Canada.
